FX's "Americans" Gets a Premiere Date

NEW YORK (TheWrap.com) - Synchronize watches, comrads: FX's KGB drama "The Americans" has a premiere date.

The series, which stars Keri Russell and Matthew Rhys as KGB spies living in suburban Washington, D.C., during the early day of Ronald Reagan's presidency, will premiere Wednesday, January 30 at 10/9c.

The couple are trying to raise two children who know nothing of thier true identities, and manage an extensive network of spies. Complicating things further is the arrival of a new neighbor, an FBI agent played by Noah Emmerich.

Created and executive produced by Joe Weisberg ("Falling Skies"), a CIA agent turned author, the series is produced by Fox Television Studios and FX Productions. Joel Fields and Graham Yost are also executive producers, along with Amblin Television heads Justin Falvey and Darryl Frank.

General responsibilities
Landlords Under the Residential Tenancies and Rooming Accommodation Act 2008 (Qld), Queensland property owners or Landlords have a statutory obligation to ensure that premises are fit to live in, maintained and in good repair.

Property managers are often engaged to assist landlords to meet these obligations and may, in some circumstances, also be held responsible for any failure of the landlord to meet these obligations.

Property managers
It is a requirement of the Property Agents and Motor Dealers Act 2000 (Qld) for property managers to obtain a certificate of registration. They are able to do this by completing an industry recognised property management training package.

Property managers are also required, under the Property Agents and Motor Dealers (Real Estate Agency Practice Code of Conduct) Regulation 2001 (Qld), to respond to maintenance and repair requests in a timely manner.

The Queensland Government Office of Fair Trading states that a property manager must:
? Respond to requests for maintenance or repairs promptly;
? Act in tenants? best interests, including getting quotes for repairs;
? Employ only licensed tradespeople for any repair or maintenance work;
? Develop and comply with a complaint handling procedure;
? Complete an inspection report and inventory;
? Accompany prospective tenants on all property inspections (unless otherwise instructed in writing).

Isabella Diefenbach ? Coroner?s inquest
In May 2010, seven week old Isabella Diefenbach, was thrown from her father?s arms after his foot went through a piece of rotten wood on the veranda of the family?s rented home in Yeppoon.

Isabella suffered a fractured skull and died a few hours later in hospital, prompting a Coronial inquest into the Queensland rental industry.
Prior to the incident, Isabella?s parents had made numerous complaints about the rotting veranda to the property manager, and inspections by three independent tradespeople had been carried out.

While each inspection determined that there was extensive termite damage to the veranda which required repair, the reports provided by the tradespeople were not read by the property manager, but forwarded to the Landlord, and ultimately the veranda was not fixed.

Coroner?s recommendations
The Coroner, Annette Hennessy, made several recommendations in relation to the Isabella Diefenbach inquest:

? That the Office of Fair Trading and other relevant authorities review the current training program for property managers, and incorporate a component on conducting inspections of decks, verandas and stairs;

? That mandatory inspections by independent licensed builders should be undertaken of residential rental properties with decks, verandas or stairs, that are 10 or more years old, prior to the property being listed on the rental market, and then at least every three years while the property is being rented out;

? That the Property Agents and Motor Dealers Act 2000 (Qld) and the Residential Tenancies and Rooming Accommodation Act 2008 (Qld) be amended to require property managers to keep a register of all maintenance or repair requests by tenants, and any instructions received from the property owner in relation to these;

? That the Property Agents and Motor Dealers (Real Estate Agency Practice Code of Conduct) Regulation 2011 (Qld) include specific obligations of property managers in relation to reading building, pest or termite inspection reports, and communicating the outcomes and recommendations to the property owner.

Best Practice Guidelines
At this stage the recommendations of the Coroner have not been implemented and it remains to be seen if the Government will amend the legislation as recommended.

While there are no industry-wide guidelines or standards in relation to building, pest or termite inspection reports for property management, the Real Estate Institute of Queensland (?REIQ?) provided the following steps for best practice when asked to comment in relation to the Isabella Diefenbach inquest:

? Property managers should carefully read reports to determine whether any defects in the property have been identified and whether any repair works or maintenance are recommended;

? Property managers should forward reports to the Landlord highlighting any relevant repair and maintenance issues identified and seek the Landlord?s written instructions in relation to those issues;

? In circumstances where reports identify serious repair and maintenance issues which pose an immediate risk to Tenants and visitors, property managers should seek urgent instructions from the Landlord to enable them to arrange for the necessary repairs and maintenance as soon as possible; and

? Property managers should implement a diary or reminder system for following up instructions from the Landlord for all outstanding repair or maintenance issues. All follow up attempts and communication with the Landlord in relation to such matters should be recorded in writing and retained on file.

Overconfidence About Future Failure

Over-precision doesn?t necessarily lead us to think we?re better negotiators than we actually are. Rather, it causes us to trust our initial instincts too much.

Sometimes we?re actually overconfident that we?ll perform?worse?than others. This tendency applies to competitive situations, including negotiation.

Those who underestimate their ability to be competitive usually will choose to stay out of a negotiation.

You might know that a company has cheated you out of some money, but unless you have strong evidence, you probably won?t pursue the case ? even if the other side would have difficulty mounting a defense.

  • And if you think you wouldn?t win in court, you?re unlikely to push as hard as you should in your negotiations over a settlement.

Research shows that when a tight deadline is imposed on a negotiation, both sides routinely think the deadline will hurt them and benefit their counterparts. Although it?s true that time pressure will force you to concede more quickly, the deadline will exert just as much pressure on the other side ? a fact that many negotiators forget.

Overconfidence About Future Success

Of course, negotiators also can be overconfident of their chances of ?winning? a negotiation or competition. When a task is easy, when you side seems strong, or when you are highly motivated to succeed, you are likely to believe that you will best the other side.

In a union-management negotiation, for instance, if the union?s strike fund is flush, the union may be more motivated to hold out for its demands than if reserves are low.

Yet negotiators often fail to consider a crucial factor: how strong their side is in relation to the other side. Even a strong union could not expect a quick, favorable settlement to contract negotiations with a company that has a huge stock of surplus inventory and substantial cash reserves.

As a rule, negotiators spend too much time thinking about their own strengths and weaknesses, and not enough time thinking about the other side?s bargaining position.

Consequently, when both sides feel their case is strong, protracted and painful battles of will are likely.

Consider when this happens in legal disputes. Plaintiffs with weak cases are willing to settle, as are weak defendants.

  • But when both sides believe their cases are strong, they refuse to settle and wind up in court ? ultimately a mistake for one side.?

Enthuse Raises $1.3M From Greystripe Co-founder And Others To Help Sports Teams Reward Their Fans

On the flip side, Enthuse enables schools and sports franchises to integrate with their API and SDK to quickly deploy social loyalty programs in their own, branded apps. To help it gain momentum and go after more collegiate and professional franchises, the startup is today announcing that it has raised $1.3 million from Allegro Venture Partners, Bee Partners and a handful of angel investors, including Maurice Werdegar of Western Technology Investment, Greystripe co-founder and YesVideo CEO Michael Chang, Peggy Taylor of B3 Ventures and a former senior exec at PeopleSoft and San Francisco 49er, Harris Barton.

Clinton pushes US bid for Czech nuclear project

PRAGUE (AP) ? U.S. Secretary of State Hillary Rodham Clinton lobbied the Czech government Monday to approve an American bid for a $10 billion expansion of a nuclear power plant amid fierce competition from a rival Russian offer.

Clinton made her pitch for the American energy giant Westinghouse Electric Co. in meetings with Prime Minister Petr Necas and other senior Czech officials in Prague. Speaking to reporters, she stressed the need for the Czech Republic to wean itself off of a dependency on Russia for fuel.

"We are encouraging the Czech Republic to diversify its energy sources and suppliers," Clinton said. "Given how long-term and strategic this investment is, the Czech people deserve the best value, the most tested and trustworthy technology, an outstanding safety record, responsible and accountable management."

The Czechs get 60 percent of their oil, 70 percent of their natural gas and all of their nuclear reactor fuel from Russia. That leaves the NATO member highly susceptible to economic and political pressure from Moscow, which dominated the Central European country from the end of World War II to the fall of the Iron Curtain.

Revitalizing the Temelin nuclear power plant is a big part of the Czech agenda to radically boost its nuclear power production, defying global skepticism about the use of atomic energy in the aftermath of last year's meltdown at Japan's Fukushima plant. And the Obama administration is hoping to get some of the windfall by securing Westinghouse's bid. The project could generate 9,000 American jobs, U.S. officials said.

For the United States, the battle for the Temelin contract is an example of an increasingly prominent element of foreign policy: Going to bat for American companies. If this was once a less-promoted if widely understood element of private diplomatic relations, what Clinton calls "economic statecraft" has now become an endeavor U.S. officials proudly promote as part of their jobs-building effort for the United States.

"We are not shy about pressing the case for Westinghouse," Clinton said. "We believe that company offers the best option for the project in terms of technology and safety. It would clearly enhance Czech energy security and further the nuclear cooperation between our countries, and it would create jobs and economic opportunity for Czechs and Americans."

To make the case, Clinton and other officials are cautioning the Czechs about the dangers of again putting their energy future in the hands of Russia. They need only point to 2008, when Russia sharply reduced oil supplies to the Czech Republic immediately after a U.S.-Czech agreement on a missile defense installation. The Russians blamed the decline on technical problems.

Still, a consortium led by Russia's Atomstroyexport may win the competition to build two new reactors at the Temelin plant, amid American grumbling over alleged bribes. The Czech government is expected to evaluate the final bids in December and make a decision in 2013. The reactors won't be operational until around 2025.

Clinton is in Prague on the first leg of a five-day trip to Europe. From the Czech capital, she'll travel later Monday to Belgium. Further stops are scheduled for Ireland and Northern Ireland. Focuses include promoting human rights and democracy across Eastern Europe and Central Asia, and NATO support for Turkish efforts to beef up defense of its volatile border with Syria.

In Brussels on Tuesday, the alliance's members are likely to give formal endorsement to Turkey's request for Patriot missiles to help it respond to a series of Syrian rockets that have violated Turkish airspace. Five Turks have been killed. Decisions on how many batteries and where to deploy them will then be referred to national governments, said U.S. officials, speaking on condition of anonymity because they weren't authorized to speak publicly about NATO deliberations.

The U.S., Germany and the Netherlands are the probable providers. Each has experts investigating possible deployment sites near the border. But it will be weeks before any anti-missile batteries reach Turkey, the officials said.

Clinton also is holding private talks Monday evening with Pakistan's foreign minister and military chief to coordinate security and peace strategies in Afghanistan as the U.S. and its partners plan to withdraw most foreign troops through the end of 2014.
